Hobbs Straus attorneys successfully obtained the first Interior Board of Contract Appeals ruling entitling a tribal school to 100% of administrative cost grant funding in Alamo Navajo School Board and Miccosukee Corporation v. BIA, IBCA 3463-3466, IBCA 3560-3562 (Dec. 4, 1997).

Management, Development Consulting & Other Agreements

  • Negotiate agreements necessary to establish and operate gaming facilities by Indian tribes, including:
    • Management contracts
    • Development agreements
    • Land purchase agreements for property conveyed to the United States in trust in order to make the land eligible for gaming under federal law
    • Assist in obtaining the necessary approvals from the Bureau of Indian Affairs (BIA) and the National Indian Gaming Commission (NIGC)
  • Provide counsel and assistance to establish destination resort/casinos, including:
    • Draft and final preparation of application to the BIA to take the lands involved into federal trust status
    • Secure clearance from the NIGC for long term development agreements
