In 2007, Hobbs Straus attorneys helped to secure financing with consent to exclusive tribal court jurisdiction for Oklahoma tribal casino development.

Health Care

  • Provide counsel to tribes and tribal organizations on operation and expansion of health programs under the Indian Self-Determination and Education Assistance Act (ISDEAA).
  • Advocate for Indian health legislation and enhanced appropriations to better address the health care needs of Indian communities.
  • Monitor and participate in regulatory procedures on Indian health issues.
  • Advocate for changes in Medicare and Medicaid laws and policies to reduce barriers to participation by Indian people and Indian health programs.
  • Negotiate contracts and self-governance agreements for the operation of Indian Health Service (IHS)-funded hospitals and other health programs.
  • Provide advice on the application of the Federal Tort Claims Act (FTCA) to medical malpractice claims against tribal health contractors.
  • Provide advice on the eligibility rules governing the provision of IHS-funded health services and the authority of tribes to make the determination to serve non-Indians.
  • Advise on personnel issues, federal and state licensing requirements and Indian and tribal employment preference laws.
  • Provide counsel related to JCAHO or alternative standards, and compliance actions.
  • Assist tribal clients in complying with Emergency Medical Treatment and Active Labor Act (EMTALA) and the Health Insurance Portability and Accountability Act (HIPAA).
  • Provide counsel on application of Stark and anti-kickback laws to physician/hospital agreements.
